Hundreds of prisoners to be released early from October 1

Hundreds of prisoners are scheduled for early release from October 1 as part of the Government's expanded scheme. Approximately 5,000 individuals are expected to be freed over the next year, a reduction from an initial target of 6,000. The Ministry of Justice reported the prison population in England and Wales stood at 87,499 on Monday, an increase of 1,738 over the preceding three months.

Scheme Details and Exclusions

The expanded early release programme follows a previous process that saw 13,325 prisoners freed between October 2023 and September 2024. The current initiative is facilitated by the 2026 Sentencing Act, which permits ministers to lower the release point for certain inmates from 40% to one-third of their fixed-term sentence. However, individuals convicted of offences including manslaughter, rape, and serious child sex offences, such as members of child grooming gangs convicted of indecent assault, are excluded from this scheme.

Ministers have stated the scheme is necessary to alleviate pressure on the overcrowded male prison estate and prevent the justice system from facing collapse. The decision to exempt rapists and serious child sex offenders was made after initial plans faced significant criticism. Justice Secretary Alex Norris has issued an apology to victims for the period of uncertainty experienced during the review of the scheme's parameters.

The prison population in England and Wales has seen a notable increase, with figures rising by 1,738 in the three months leading up to Monday. This surge contributes to the ongoing challenge of managing capacity within the prison system. The total prison population is currently 1,022 below the record high of 88,521, which was recorded on September 6, 2024.
